Terms of Use

These Terms of Use (hereinafter referred to as the “Terms”) stipulate the conditions for use of the “Illumidea” service (hereinafter referred to as the “Service”) provided by the Illumidea Team (hereinafter referred to as the “Organization”). All users of the Service are to use the Service in accordance with the Terms.

1. Definitions

  1. “Registered User” means an individual who has been registered as a user of the Service in accordance with Article 3 (Registration for Use).
  2. “Participating User” means a person designated by a Registered User as a user of the Service.
  3. “User” means a Registered User or a Participating User.
  4. “Input Data” means content that is posted or otherwise transmitted by a User through using the Service.
  5. “Output Data” means data that is output by the Service as a result of a User's use of the Service.

2. Application

  1. These Terms shall apply to all relationships between the User and the Organization regarding use of the Service.
  2. In relation to the Service, the Organization may stipulate various types of rules for use of the Service (hereinafter referred to as “Individual Regulations”), in addition to the Terms. Those Individual Regulations, irrespective of their name, shall constitute a part of the Terms.
  3. If the provisions of the Terms conflict with the provisions of an Individual Regulation of the preceding article, the provisions of the Individual Regulation shall take precedence unless otherwise stipulated in the Individual Regulation.

3. Registration for Use

  1. Registration for use of the Service shall be completed when a prospective registrant agrees to the Terms and uses the method stipulated by the Organization to apply for registration for use and the Organization approves the application.
  2. If the number of applicants for registration exceeds a certain number, or if the Organization judges that an applicant for registration for use falls under any of the reasons below, the Organization may refrain from approving the application for registration for use, and it shall not be obligated to conduct any disclosure of the reason for that denial.
    1. When false information is given when applying for registration for use
    2. When the application is made by a person who has previously violated the Terms
    3. Other cases in which the Organization judges that registration for use is inappropriate

4. Account Management

  1. The Registered User shall, at his or her own liability, appropriately manage and store the account information and passwords (hereinafter referred to as “Identity Confirmation Information”) for external services related to the Service, and the Registered User may not allow third parties to use such information or lend, transfer, change the name of, or sell such information.
  2. The Registered User may not, under any circumstances, transfer or lend Identity Confirmation Information to a third party or share it with a third party. When the Organization confirms a match of Identity Confirmation Information, it will deem that the Registered User who has the relevant account used the Service.
  3. The Registered User shall bear liability for damage caused by inadequate management of Identity Confirmation Information or others, errors in use, or use by a third party, and the Organization will not bear any liability for such damage.

5. Prohibited Matters

When using the Service, the User may not conduct the actions below.

  1. Actions that violate laws, regulations, or public order and morals
  2. Actions related to criminal activity
  3. Actions that infringe copyrights, trademarks, or other intellectual property rights contained in the Service, such as the content of the Service
  4. Actions that destroy or interfere with functions of a server or network of the Organization, other user, or other third party
  5. Actions that may interfere with operation of the Organization's services
  6. Unauthorized access or attempts to gain unauthorized access
  7. Collecting or accumulating personal information about other users
  8. Using the Service for an unauthorized purpose
  9. Actions that cause a disadvantage, damage, or discomfort to other user of the Service or other third party
  10. Impersonating another user
  11. Advertising, publicity, solicitation, or sales activities on the Service that are not permitted by the Organization
  12. Actions for the purpose of meeting a stranger of the opposite sex
  13. Directly or indirectly providing benefits to antisocial forces in relation to the Organization’s services
  14. Use to develop competing services
  15. Modifying, copying, leasing, selling, or distributing the Service
  16. Attempting or assisting a search for the Service’s source code or others
  17. Automatically or programmatically extracting the Service’s data or output
  18. Other actions that the Organization judges inappropriate

6. Change or Termination of Service Content

  1. The Organization shall be able to, for its own reasons, change the content of the Service or suspend or discontinue provision of all or part of the Service without notifying the User in advance.
  2. The Organization shall not bear any liability for disadvantages or damages incurred by the User or a third party as a result of measures taken by the Organization based on this Article.

7. Restriction of Use, and Cancellation of Registration

  1. If the Registered User falls under any of the items below, the Organization shall be able to, without prior notice, restrict the Registered User from using all or part of the Service or cancel his or her registration as a Registered User.
    1. When the Registered User has violated any of the provisions of the Terms
    2. When it is found that there is a falsehood in a registered item
    3. When there is no response to contact from the Organization for a certain period
    4. When the Registered User has not used the Service at all for more than three months since the last use
    5. In any other case in which the Organization judges that use of the Service is inappropriate
  2. The Organization will not bear any liability for damage incurred by the User as a result of actions taken by the Organization based on this Article.

8. Withdrawal from the Service

The Registered User shall be able to withdraw from the Service by conducting the withdrawal procedures stipulated by the Organization.

9. Disclaimer of Warranty and Exemptions

  1. The Service is provided as a work in progress and by its nature it may contain problems, malfunctions, or erroneous statements. The Organization makes no warranty, explicitly or implicitly, that the Service will be free from actual or legal defects (including defects related to safety, reliability, accuracy, completeness, effectiveness, suitability for a particular purpose, security, errors or bugs, or infringement of rights).
  2. The Organization will not bear any liability for any type of damage incurred by the User because of the Service, excluding cases due to the Organization’s intention or gross negligence.
  3. The User shall acknowledge in advance that there is a possibility that the output content based on this function may contain incorrect information or harmful or biased content. The Organization does not guarantee that the output content based on this function will not infringe the rights of the Organization or third parties. In addition, there is a possibility that the data that is output by the Service may be inaccurate or inappropriate, but this does not reflect the views of the Organization.
  4. The Organization will not bear any liability for transactions, communication, or disputes between the User and other users or third parties in relation to the Service.
  5. The User shall bear all liability for problems that arise in relation to information posted by the User itself, and the Organization will not bear any liability for such problems.

10. Changes of the Terms of Use

  1. When any of the cases below apply, the Organization shall be able to change the Terms without being required to obtain User’s individual consent.
    1. When change of the Terms is compatible with users’ general interest
    2. When change of the Terms is not contrary to the purpose of the Service Usage Agreement and is reasonable in light of the necessity of the change, the suitability of the changed content, and other circumstances related to the change
  2. For a change of the Terms based on the preceding clause, the Organization will notify the User in advance of the fact that the Terms will be changed, the content of the changed Terms, and the date when the change will go into effect.

11. Compliance with OpenAI’s Terms of Use

When using the Service, the User shall comply with OpenAI's Terms of Use and policies (Service Terms, Sharing & Publication Policy, and Usage Policies).

12. Handling of Information

  1. Input data that the User collects or posts by using the Service, and output data that is output by the Service, will be stored in this system. When using the Service, the User shall entrust the Organization with the handling of input data and output data.
  2. If the Organization judges that input data or output data stored in this system is inappropriate for the Service or will cause a problem with the Service, such as when there is storage in the System in violation of a law or regulation, the Organization shall be able to immediately erase that input data or output data without notifying the User in advance.
  3. The Organization will use input data and output data for the purposes of improving and enhancing service content and conducting research and development of services.
  4. The Organization shall be able to, at its discretion, use and disclose, as statistical information in a form by which individuals cannot be identified, information and data that the User provides to the Organization, and the User shall not object to this.
  5. The Organization’s handling of user information shall be according to the stipulations of a separate privacy policy for the Service, and the User shall agree that the Organization will handle the User’s use information in accordance with that privacy policy.
  6. The Registered User can erase input data that has been posted or collected by using the Service. In addition, after the Registered User withdraws from the Service, the Organization can erase all input data and corresponding output data that the Registered User posted or collected. The Organization is not obligated to restore that input data or output data. The Organization will not issue a certificate of erasure for the erasure of such input data or output data. The Organization shall not bear any liability for damage incurred by the User as a result of that erasure.
  7. The Organization does not guarantee that input data or output data stored in this system will not be eliminated or damaged.

13. Attribution of Rights

  1. All intellectual property rights related to the Service belong to the Organization or the party that has granted a license to the Organization, and permission to use the Service based on the Terms does not mean permission to use the intellectual property rights of the Organization or the party that has granted a license to the Organization in relation to the Service.
  2. The User represents and warrants to the Organization that the User has the lawful right to use the input data, input or transmit it to the Service, or provide it to the Organization, and that such actions will not infringe the rights of third parties.
  3. The User will grant to the Organization a worldwide, non-exclusive, free-of-charge, sublicensable, and transferable license to use, reproduce, distribute, create derivative works from, display, and execute the input data. The User will also grant to other users a non-exclusive license to use, reproduce, distribute, create derivative works from, display, and execute the input data that the User posts or otherwise transmits by using the Service.
  4. The User shall agree to not exercise moral rights of authorship against the Organization or parties that have succeeded rights from or been granted rights by the Organization.
  5. The Organization has the authority to use, without the User’s permission, any feedback and suggestions from the User for the improvement of this system.

14. Handling of Personal Information

The Organization shall follow the Organization’s “Privacy Policy” to appropriately handle personal information obtained through use of the Service.

15. Notification or Communication

Notification or communication between the Registered User and the Organization shall be conducted by using the method stipulated by the Organization. Unless the Registered User uses the method separately stipulated by the Organization to notify the Organization of a change of contact information, the Organization shall deem that the currently registered contact information is valid, shall send notifications or communication to that contact information, and shall deem that such notifications or communication have reached the Registered User at the time they are sent.

16. Prohibition of Transfer of Rights and Obligations

The Registered User may not transfer its position under the Use Agreement or its rights or obligations under the Terms to a third party or offer them as collateral without the Organization’s prior written consent.

17. Governing Laws and Court Jurisdiction

  1. The laws of Japan will be the governing laws for interpretation of the Terms.
  2. If a dispute arises in relation to the Service, Tokyo District Court will have exclusive jurisdiction.

Established July 1, 2024

The Terms have been written by using Japanese as the official text. In the event of any discrepancy between a translated version and the Japanese version of the Terms, the Japanese version shall prevail.
